This work traces, departing from the method of structures of thought, the influence of the doctrines of Duns Scotus and Ockham in 19 th Century dogmatics. Milestones of this transformation are Windscheid’s doctrine on legal rights and Jellinek’s doctrines on public legal rights and the self-limitation of the state, as well as Laband’s distinction between the material sense of law and the formal. This multiplication of formal distinctions dissolves the modern subject in the system. Only a radical approach enables us (...) to understand the sense of legal modernity: the separation made by Scotus and nominalism between object and subject is what in the final instance explains liberal (possessive) individualism and its legal consequences. Despite its obvious advantages, the disruptive development of neurotechnology can pose risks to fundamental freedoms. In the context of such concerns, proposals have emerged in recent years either to design human rights de novo or to update the existing ones. These new rights in the age of neurotechnology are now widely referred to as “neurorights.” In parallel, there is a considerable amount of ongoing academic work related to updating the right to freedom of thought in order to include the protection (...) of “freedom of thinking” (i.e., freedom of thought itself) and not only its social manifestations. Neurorights such as cognitive liberty, free will, mental freedom, and mental self-determination come into play here. Importantly, freedom of thought has often been considered a prerequisite for all the other fundamental freedoms and rights. In any case, just as other rights require additional legal instruments to guarantee their compliance, substantial neurorights will probably require specific complementary developments in procedural law. In relation to this, there is a long tradition of habeas corpus as an emergency remedy to enforce the rights of a citizen against illegal or arbitrary detention. More recently, the habeas data writ has been proposed and admitted in certain countries to guarantee a person’s ownership of their personal data. In this article, we propose to expand this procedural apparatus by incorporating a third habeas, which we call habeas cogitationem: a writ aimed primarily at enforcing the right to freedom of thinking (and, subsidiarily, the rest of neurorights) against direct, harmful interferences in a person’s thought process by both public and private perpetrators. The question addressed in this paper is whether particular emotional experiences or episodes of an emotion (such as two experiences of happiness) belong to a natural kind. The final answer to this question is that although some, even many, single episodes of an emotion may group into a natural kind, belonging to a natural kind is a highly contextual matter. The proposal relies on two premises. First, a conception of natural kind-hood that follows Boyd’s Homeostatic Property Cluster Theory. Second, a (...) view of emotional episodes that fits with the External Theory of Perception: typical emotional episodes are perceptual experiences of emotional affordances. After pointing out what candidates for emotional homeostatic properties could be like and suggesting some examples of emotional homeostatic mechanisms, the authors conclude that there are property clusters of emotional perceptions stabilized by homeostatic mechanisms. In spite of this, what counts as an emotional natural kind depends on many factors, not all of them natural: world properties, bodily and mental states of the agent, learning mechanisms that help us to satisfactorily navigate in the world, cultural differences that determine our perceptual style, as well as different interests which guide the explanation and prediction of emotional episodes. The development and use of advanced and innovative neuroscience, neurotechnology and some forms of artificial intelligence have exposed potential threats to the human condition, including human rights. As a result, reconceptualizing or creating human rights (i.e. neurorights) has been proposed to address specific brain and mind issues like free will, personal identity and cognitive liberty. However, perceptions, interpretations and meanings of these issues—and of neurorights—may vary between countries, contexts and cultures, all relevant for an international-consensus definition and implementation of neurorights. (...) Thus, we encourage reflecting on the proactive inclusion of transnational, cross-cultural and contextual considerations and concerns to contribute to the global discourse. This inclusion does not mean endorsing ethical relativism but rather a call to foster a universal understanding of key concepts and concerns. Including contextual and cultural perspectives may truly anticipate global concerns which could be addressed while developing and implementing neurorights. Consequently, any ethical and/or legal regulatory framework(s) for the translational and transnational use of advanced neuroscience, neurotechnology and some forms of artificial intelligence intended to protect and safeguard human dignity should be contextually and culturally mindful, responsible, respectful and inclusive of not only human rights and fundamental freedoms but also of neurocognitive cultural diversity. En este trabajo se hace un análisis hermenéutico de la obra Constitución Social de Honduras de Ramón Rosa con el fin de revelar rasgos de la identidad hondureña que subyacen en pensadores del siglo XIX en el contexto de la Reforma Liberal. Luego de introducir datos básicos del autor, de la obra y la época histórica de su redacción, se presenta y justifica el uso de un instrumento hermenéutico para analizar dicho texto. Este instrumento divide el análisis en tres ejes (...) temáticos: antropológicos, morales y políticos; posteriormente, aplicando categorías de análisis adecuadas al fenómeno de la nacionalidad en clave de modernidad, se interpretan los contenidos del texto desde los tres ejes temáticos mencionados, para extraer rasgos identitarios desde una postura filosófica. Es así como este artículo se presenta como un primer acercamiento a la conformación de la identidad hondureña a partir de un análisis hermenéutico. (shrink)

Para el efecto se sirve de su antropología trascendental, distinguiendo en el hombre naturaleza, esencia y ser personal; sin limitarse a traslapar sino investigando mediante los métodos distintivos del saber estrictamente económico. En esta obra Leonardo Polo presenta explícitamente su pensamiento político en dos fases. En la primera diagnostica sobre la situación política actual. En la segunda propone un modelo de gobierno que empodera a la sociedad civil, y un orden político-económico fundamentado en el derecho al libre desarrollo de la personalidad.

In this article, we propose a philosophical exploration on the main problems involved in two neurorights that concern autonomous action, namely free will and cognitive liberty, and sketch a possible solution to these problems by resourcing to a holistic interpretation of human actions. First, we expose the main conceptual and practical issues arising from the neuroright to “free will,” which are far from minor: the term itself is denied by some trends participating in the neurorights debate, the related concept of (...) ultimate control is also disputed, the understanding of free will depends on cultural context, and the exercise of being free to act in several domains may be covered by other regulations. Second, we analyze the historical origin of cognitive liberty, its current status, and its relation with free will. Third, we criticize the concept of decision in mainstream action theory and propose to conceive action as a unified process constituted by three explanatory, non-sequential dimensions: intention, decision, and action realization. Fourth, we discuss two possible cases involving neurotechnologies and suggest ways to interpret them according to a unified framework in which free will and cognitive liberty fall under a single neuroright to personal autonomy. Finally, we outline a recommendation to introduce freedom of thought and personal autonomy as complementary neurorights to protect both the internal and external dimensions of thought and action. Court rulings are among the most important documents in all legal systems. This article describes a study in which natural language processing is used for the automatic characterization of Spanish judgments that deal with the physical custody (joint or individual) of minors. The model was trained to identify a set of elements: the type of custody requested by the plaintiff, the type of custody decided on by the court, and eight of the most commonly used arguments in this type of (...) judgment. Two jurists independently annotated more than 3000 judgments, which were used to train a model based on transformers. The main difficulties encountered in this task were the complexity of the judicial language and the need to work with appellate court rulings that have a more complicated structure than decisions at first instance. For the complete court rulings, the F1 score of the inter-annotator agreement ranged from 0.60 to 0.86 and the Kappa index from 0.33 to 0.73. The F1 score of the agreement between the model and the annotators ranged from 0.66 to 0.93 and the Kappa index from 0.57 to 0.80. These results in which the model performance exceeds even the inter-annotator agreement show the high ability of transformers to identify abstract entities in legal texts. (shrink)

Suddha Dharma Mandalam (SDM) is name of an ancient Hierarchy which watches over the evolutionary progress of the Humanity. In the whole Universe the Bhagavad Gita—the Yogic art of Brahman—occupies the most exalted position. The aim of this study is to explain the composition and the mystic-philosophical principles that sustain SDM Bhagavad Gita of 745 slokas and 26 chapters. Suddha Gita contains 745 verses in 26 chapters conformed by the dual extreme “The Pranava” (first and last chapters) and the central (...) body “The Gayatri” of 24 chapters (4 feet). The first (Proem) and last one (Epilogue) represent Vyasthi- and Samasthi-para aspects of The Pranava; these aspects correspond to the Brahman conception of One and Many, respectively. While 4 feet or headings (Gñana-knowledge, Bhakti-desire, Karma-action and Yoga-synthesis) correspond to 4 aspects of eternal Dharma and the 4 keys for life learning (quadruple life-path), the 24 chapters represent the 24 material tatwas. By the other hand, the greatest symbols known are The Pranava or the syllable Om and The Gayatri consisting of 24 syllables. The syllable of Pranava contains 2 expressions: 1) the analytical three-letters AUM which normally appear at the beginning of important mantras, where the first letter represents Atma or the Self-aspect of Brahman; U the Prakriti or the Not-self aspect; M the Shakti or the Force-aspect; 2) the synthetical two-letters OM which normally appear at the end of important mantras, where O (pronounced at center of the palate) integrates the 2 extreme vowels and M similar like before. The AUM at the beginning signifies that Brahman is the source from which the factors manifest themselves, and Om at the end signifies that these factors merge and become synthesized in that very Brahman. No reference has been made to the reason for the introduction by the author of the first and the twenty-sixth chapters and his linking them with the body of the twenty-four chapters compacted together under the four groups. The whole of the current recension is divided into 18 chapters and empirically divided into three shatkas—Kriya, Bhakti and Gñana shatkas, which are based on “tripada gayatri”, although Gayatri to be complete has to be “chatuspada-shadangula” representing the well-known 24 principles, six in each pada. The absence, thus, of a fourth pada as such is a serious unfortunately omission. Today Suddha Gita is valid and it is being read by many people around world, since SDM Order as an outer organization has several schools distributed in American and European countries. (shrink)

The Habermasian concept of ‘interest’ has had a profound effect on the characterization of scientific disciplines. Going beyond issues unrelated to the theory itself, intra‐theoretical interest characterizes the specific ways of approaching any science‐related discipline, defining research topics and methodologies. This approach was developed by Jürgen Habermas in relation to empirical–analytical sciences, historical–hermeneutics sciences, and critical sciences; however, he did not make any specific references to health sciences. This article aims to contribute to shaping a general epistemological framework for health (...) sciences, as well as its specific implications for the medical and nursing areas, via an analysis of the basic knowledge interests developed by Habermas. En este trabajo, inspirados por la mentalidad agustiniana, trataremos el libre albedrío como medio necesario para lograr la felicidad. Tras unas reflexiones generales sobre la mente, el libre albedrío y la felicidad, hablaremos acerca del libre albedrío como requisito para la felicidad y nos centraremos en el libertarismo. Los partidarios de esta corriente sostienen que el libre albedrío existe pero es incompatible con el determinismo, de modo que requiere alguna clase de indeterminismo. Esto trae consigo un problema de inteligibilidad: ¿acaso (...) el indeterminismo no conlleva aleatoriedad y, como consecuencia, carencia de control sobre lo que decidimos y hacemos? Sin embargo, describiremos dos propuestas libertaristas que tratan de dar una explicación inteligible al papel que desempeña el indeterminismo en el ejercicio de nuestro libre albedrío. La primera propuesta, que es ampliamente conocida internacionalmente, es la de Robert Kane. La segunda ha sido defendida por Carlos Moya, el más importante pensador libertarista dentro del ámbito hispano. (shrink)

Este artículo es un análisis de tres relatos periodísticos de la filtración de documentos de la Agencia Nacional de Seguridad de Estados Unidos, llevada a cabo por Edward Snowden: un libro, una película y una entrevista. El objetivo es sacar a la luz algunos dilemas éticos y políticos que subyacen al caso. Primero, una tensión paradójica entre la exigencia de transparencia frente al secreto estatal y la necesidad del secreto personal para el derecho a la privacidad, que refleja en nuestros (...) tiempos la dialéctica publicidad / secreto en la modernidad temprana. Segundo, la ética hack-activista enfrenta los conflictos entre anonimato y visibilidad. Tercero, los periodistas en que Snowden confía afrontan el dilema entre los deberes de la información y la protección de la confidencialidad de las fuentes. El asunto Snowden es, pues, una oportunidad para extraer algunas lecciones sobre la ética de la comunicación en la era digital. (shrink)
